The respondent brought an application under s. 74 of the Firearms Act to review the nullification of his firearms registration certificates after his rifles were reclassified as prohibited by a May 2020 regulation.
The moving party (Attorney General) brought a motion to dismiss the application on jurisdictional grounds.
The court granted the motion to dismiss, finding that the registration certificates were revoked by operation of law due to the legislative change, and therefore there was no decision by the Registrar of Firearms for the court to review.
