The applicant towing company sought judicial review of the Toronto Police Services Board's decision to cancel a tendering process for towing contracts and offer interim extensions to existing contract holders without affording the applicant an opportunity to make submissions.
The Divisional Court held that municipal procurement decisions involving public funds are subject to judicial review.
Finding a breach of procedural fairness, the court granted an order of mandamus requiring the Board to offer the applicant the same one-year contract extension that was offered to other towing companies, rather than awarding the full multi-year contract.
