The Information and Privacy Commissioner brought a motion for directions regarding the assembly of the Public and Private Records for a pending judicial review.
The applicant sought to have certain redacted pages and submissions placed in the Public Record, and to have an earlier judicial review heard together with the current one.
The Commissioner also sought to remove an erroneously included internal memorandum from the record.
The court ordered that the disputed pages and submissions remain in the Private Record to avoid predetermining the judicial review, declined to join the moot earlier judicial review, and ordered that the internal memorandum remain in the Public Record as it was before the decision-maker.
