The applicants received a Notice of Proposal to revoke their motor vehicle dealer registrations.
They negotiated a consent order with the Registrar, issued by the Licence Appeal Tribunal, which waived their right to a hearing and allowed automatic revocation upon breach of conditions.
The Registrar subsequently revoked their licences without a hearing.
On judicial review, the Divisional Court held that the statutory right to a hearing under section 7 of the Motor Vehicle Dealers Act is for the public benefit and cannot be waived by the parties.
The consent order and subsequent revocation were declared invalid.
