1These are the reasons for the Board’s decision concerning the application of J.P. (the “Applicant”). The application was determined eligible for a review on June 22, 2010. After reviewing the application and the Society’s summary reply, the Board has decided to proceed to a written review and to dismiss the application for the following reasons.
2The Applicant raised in her application the following issues: the Society did not allow her or her attorney to access her file, the Society has recorded inaccurate information in her file and she was denied access to her 3 children, B., I. and C. without explanation.
3Concerning the access to her children, the Board concludes that the issue has been decided by the Court preventing the Board to proceed further with the application. B. has been declared a Crown ward with no access for the purpose of adoption on January […], 2009 and the appeal of the Applicant has been dismissed. For I. and C., the Court has made both of them Crown wards with no access for the purpose of adoption on February 2, 2010. The appeal from the Applicant on that last decision will be heard in August 2010. As the Court has made a determination that no access would be given to the Applicant, the Board will not review the complaint regarding access which is a service sought by the Applicant.
4For the inaccuracy in the file, the Applicant must proceed with her complaint with the Society first before having access to the Board review. The Board can only review a final decision of the internal complaint review panel of the Society. By making a complaint to the Society the Applicant will have an opportunity to have access to her file and argue the issue of inaccuracy of information.
5Considering the reasons above, the Board dismisses the application of J.P..
