The appellants appealed the City of Burlington Committee of Adjustment's decision to deny a minor variance for a driveway expansion at their residential property.
The City did not oppose the variance at the hearing.
The Tribunal found that the requested variance met the four tests under section 45(1) of the Planning Act, as it maintained the general intent of the Official Plan and Zoning By-law, was desirable for the appropriate development of the land, and was minor in nature.
The appeal was allowed and the variance was authorized.
