The complainant, a female member of a municipal road crew, alleged that her supervisors discriminated against her on the basis of sex by transferring her to another crew, attempting to force her resignation, and creating an abusive working environment through offensive remarks.
The Board of Inquiry found that the transfer was motivated by genuine concerns about her work performance rather than gender bias.
Although the supervisor held sexist views and made offensive remarks, the Board concluded that the incidents did not occur with sufficient frequency or offensiveness to constitute a discriminatory term or condition of employment under the Ontario Human Rights Code.
The complaint was dismissed.
