The applicant brought a motion seeking an Order staying his removal to Nigeria pending a determination of his application for leave and for judicial review of a negative Pre-Removal Risk Assessment (PRRA) decision.
The PRRA Officer had denied the application on the basis that the evidence was insufficient to overcome the Refugee Protection Division's previous adverse credibility findings regarding the applicant's claimed sexual orientation.
The Federal Court dismissed the motion for a stay of removal, finding that the applicant had not established a serious issue to be tried.
The Court noted that the Officer's assessment of the evidence was reasonable and that no exceptional circumstances warranted intervention.
