The applicant sought judicial review of a decision of the Appeal Board of the Council of the Innu of Ekuanitshit dismissing her challenge to the election of a band councillor.
The applicant argued the councillor was ineligible because of a past summary conviction offence, and that the Appeal Board was improperly constituted.
The Federal Court dismissed the application.
The Court found the procedural fairness challenge to the Board's composition was raised too late and lacked merit.
The Court also held that the Board reasonably interpreted the term "criminal record" in the band's electoral customs as applying only to indictable offences, not summary convictions.
