The accused was tried on charges of sexual assault and break and enter with intent to commit sexual assault arising from an alleged late-night intrusion into the complainant’s home.

After reviewing extensive inconsistencies, internal contradictions, conflicts with other accepted evidence, and serious reliability concerns in the complainant’s testimony, the court found her evidence could not be relied upon.
The Crown failed to prove the allegations beyond a reasonable doubt, and the accused was acquitted on both counts.
