The court removed the respondent as executor, appointed the Estate Trustee During Litigation in his place, and ordered the respondent to repay misappropriated funds, pay occupation rent, and bear the tax penalties incurred due to his inaction.
The court also set aside a RRIF beneficiary designation due to undue influence and awarded full indemnity costs against the respondent personally.
