The defendants moved to strike a self-represented plaintiff's fresh as amended statement of claim arising from an academic dispute with a university professor and the university.
The court held the pleading disclosed no reasonable cause of action, failed to plead the constituent elements of contract, negligence, or intentional infliction of emotional distress, and improperly sought civil damages for matters that were, in substance, challenges to academic decisions.
The court further held that discrimination allegations belonged within the statutory human rights regime and that any challenge to the university's handling of exams and grades had to proceed, if at all, by judicial review.
The claim was struck without leave to amend.
