AMENDED ORDER
WHEREAS a hearing into Notice of Proposal number 16102 dated March 11, 2008 to suspend liquor licence number 804183 issued to Shooters Sports Bar Inc., (the "Licensee"), operating as SHOOTERS SPORTS BAR, 980 Central Park Drive, Unit 10, Brampton, Ontario, L6S 3L7, on the basis of alleged violations of section 43 and subsections 45(1) and 45(2) of Ontario Regulation 719/90 (the "O.Reg") made pursuant to the Liquor Licence Act, was held on June 19, 2008 and January 12, 2009 in the City of Toronto;
AND WHEREAS in its decision of February 26, 2009 the Board found that the Licensee had violated section 43 and subsection 45(2) of the O.Reg and dismissed the allegation of a violation of subsection 45(1) of the O.Reg;
AND WHEREAS in its decision of April 14, 2009 the Board ordered a FOURTEEN (14) day suspension of the liquor licence;
AND WHEREAS in its Order of May 4, 2009, the Board ordered the suspension period to be served from 11:00 a.m. on July 12, 2009 until 2:00 a.m. on July 26, 2009;
AND WHEREAS the Licensee appealed the Board's Decision to the Ontario Superior Court of Justice ("Divisional Court") and by an Order, the Court stayed the period of suspension of the licence pending the outcome of the appeal;
AND WHEREAS the appeal was dismissed by the Divisional Court by an Order dated November 29, 2011;
AND WHEREAS the Licensee has proposed suspension dates which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that liquor licence number 804183 issued to Shooters Sports Bar Inc., (the "Licensee"), operating as SHOOTERS SPORTS BAR, 980 Central Park Drive, Unit 10, Brampton, Ontario, L6S 3L7, be SUSPENDED for FOURTEEN (14) consecutive days to commence at 11:00 a.m. on February 19, 2012 and continue until 2:00 a.m. on March 4, 2012.
