The owner applied for minor variances to regularize five basement dwelling units and construct a fire access/egress stair in an existing 26-unit apartment building.
The requested variances included reductions in lot width, lot area, setbacks, and soft landscaping.
The Committee of Adjustment found that the variances met the four-part test under subsection 45(1) of the Planning Act, noting that the proposal legalized existing conditions, achieved intensification objectives, and maintained the character of the neighbourhood without causing adverse impacts.
The application was granted subject to conditions, including entering into a Maintenance and Liability Agreement with the City.
