Exemptive relief granted to permit inter-fund trades between mutual funds, pooled funds, and managed accounts.
The applicant, an investment fund manager and portfolio manager, applied to the Ontario Securities Commission for exemptive relief from the inter-fund trading prohibitions in National Instrument 81-102 and National Instrument 31-103.
The requested relief would permit mutual funds, pooled funds, and managed accounts managed by the applicant to engage in inter-fund trades of debt and exchange-traded securities, and to execute trades of exchange-traded securities at the last sale price rather than the closing sale price.
The Commission granted the requested exemptions, subject to conditions including independent review committee approval and compliance with specific pricing and execution requirements under National Instrument 81-107.
