The worker, a roofer, suffered a work-related fall in 1996, injuring his knees and right shoulder.
Years later, he sought ongoing entitlement for bilateral knee and right shoulder conditions, as well as Loss of Earnings (LOE) benefits.
The Appeals Resolution Officer allowed the appeal in part, granting ongoing entitlement for the right knee on an aggravation basis due to a pre-existing condition.
However, ongoing entitlement for the left knee and right shoulder was denied, as the evidence showed the left knee had degenerative changes unrelated to the accident, and the right shoulder injury was attributed to a subsequent non-work-related fall at home.
LOE benefits were also denied because the worker's loss of earnings was not caused by the compensable right knee injury.
