The Ombudsman investigated a complaint regarding a closed meeting held by the council for the County of Norfolk.
The council had gone into closed session to receive a deputation from the Port Dover Community Health Centre Board and to receive legal advice, citing the 'personal matters' and 'advice subject to solicitor-client privilege' exceptions under the Municipal Act, 2001.
The Ombudsman found that the deputation did not qualify as personal information, as it related to the professional capacity of the Board members, and therefore did not fit within the 'personal matters' exception.
However, the portions of the closed session before and after the deputation, during which legal advice was provided, fit within the 'advice subject to solicitor-client privilege' exception.
The Ombudsman recommended that the council ensure future closed sessions strictly adhere to statutory exceptions.
