The worker suffered a compensable back injury and sought physiotherapy treatment at a clinic not registered with the WSIB.

The worker incurred $632.50 in out-of-pocket expenses and sought full reimbursement.

The WSIB initially reimbursed the expenses at the reduced WSIB fee schedule rate.

On appeal, the Appeals Resolution Officer allowed the objection in part, finding that the worker was entitled to full reimbursement for the period before she was informed of the requirement to attend a registered clinic and the applicable fee schedule.

Expenses incurred after the worker was informed of the rules were appropriately reduced to the WSIB fee schedule.

The worker objected to a case manager's decision denying full loss of earnings (LOE) benefits beyond November 16, 2009, after he refused modified work following a right thumb fracture.

The Appeals Resolution Officer found that the modified work offered by the employer was suitable and within the worker's functional abilities.

However, because the case manager did not provide written notice of the decision until December 9, 2009, the worker was entitled to full LOE benefits up to that date.

The objection was allowed in part.
