The appellant requested access to an agreement between the Municipality of Metropolitan Toronto and a named association regarding a managed care prescription medication program.
The Municipality granted partial access but withheld portions under section 10(1)(a) of the Municipal Freedom of Information and Protection of Privacy Act, claiming they contained third party commercial information.
The appellant appealed, challenging the adequacy of the decision letter, requesting access to the other parties' representations, and arguing a compelling public interest in disclosure.
The Inquiry Officer found the decision letter inadequate but declined to order a new one, and refused to order an exchange of representations.
The Officer upheld the application of the section 10(1)(a) exemption, finding the withheld information was commercial, supplied implicitly in confidence, and its disclosure could reasonably prejudice the association's competitive position.
The Officer also found no compelling public interest in disclosure under section 16.
The Municipality's decision was upheld.
