Human rights complaint dismissed; marital status does not include the identity of one's spouse.
The complainant alleged she was refused employment as an account clerk with the Township because her husband was employed as a police officer, claiming discrimination based on marital status and sex.
The Board of Inquiry dismissed the complaint, finding that 'marital status' does not encompass the identity of one's spouse.
Furthermore, the Board held that even if it did, the absence of a conflict of interest was a bona fide occupational qualification, as the complainant would have processed her husband's expense claims and had access to sensitive police documents.
