The Association of Professional Engineers of Ontario brought disciplinary proceedings against a former member and a certificate of authorization holder for professional misconduct related to a noise assessment study in a condominium.
The respondents admitted to acting negligently, failing to comply with applicable standards, and failing to disclose a conflict of interest by appearing to prefer the condominium's interests over the unit owner's interests.
The Discipline Committee accepted an agreed statement of facts and a joint submission on penalty, ordering a reprimand, a two-month suspension of the certificate of authorization, practice restrictions, a $4,000 fine, and publication of the decision.
