The worker objected to a Case Manager's decision finding that she had the skills and functional abilities to earn minimum wage in the suitable and available employment or business (SEB) of Other Sales and Related Occupations following a right arm soft tissue injury.
The Appeals Resolution Officer reviewed the medical evidence and the National Occupational Classification (NOC) codes.
The Officer found that the identified SEB of Other Sales and Related Occupations exceeded the worker's functional abilities due to the likelihood of repetitive right arm use.
However, the Officer identified an alternative SEB of Library, Correspondence and Related Information Clerks, which was within the worker's functional abilities and skills.
The Officer upheld the determination that the SEB earnings of minimum wage were appropriate.
The worker's objection was allowed in part.
