The Ontario Review Board conducted an annual review of the accused's conditional discharge.
The accused had previously been found not criminally responsible for two counts of sexual assault.
The hospital, Crown, and accused jointly submitted that the accused continues to represent a significant threat to public safety and that the conditional discharge should be maintained.
The Board accepted the joint submission and the evidence of the treating psychiatrist, finding that the accused's poor insight and history of medication noncompliance posed a high risk of decompensation and violence if absolutely discharged.
The conditional discharge was continued.
