The applicant appealed a decision of an Employment Standards Officer refusing to issue an Order to Pay for unpaid commissions.

The applicant, a sales representative, resigned before the end of the fiscal year and claimed he was owed commissions on sales made prior to his departure.

The Ontario Labour Relations Board found that under both the previous contract and the proposed new commission structure, commissions were only payable at the end of the fiscal year.

Because the applicant quit before the end of the fiscal year, he was not entitled to the commissions.

The application was dismissed.

The applicant sought to vary a previous Board order regarding essential services for meat inspectors during a strike, requesting limited inspection of meat processing operations or an amendment to the essential services agreement to provide more inspectors.

The Board found no change in circumstances to justify varying the order and no evidence requiring a permanent increase in the essential services complement.

However, the Board directed the parties to negotiate an emergency services protocol to address situations where essential service teams are diverted to investigate suspected illegal slaughter.
