The employer objected to the WSIB auditor's decision to retroactively adjust premiums to January 1, 2005, following a 2007 audit that found the employer was incorrectly segregating payroll.
The employer argued that the retroactive date should be January 1, 2007, because they had relied on instructions from a previous audit in 2000.
The Appeals Resolution Officer found that the employer's misunderstanding of the 2000 audit instructions did not justify departing from the WSIB policy on employer premium adjustments, which allows for retroactive adjustments to correct errors.
The objection was denied, and the January 1, 2005 effective date was upheld.
