The Ombudsman investigated complaints that the Town of Midland council held illegal closed meetings on September 14 and October 13, 2015.
The Ombudsman found that the September 14 in camera discussion regarding a housing development did not fit within the 'litigation or potential litigation' exception, and that council improperly voted during this closed session.
However, the October 13 closed session regarding a letter from a member of the public was permitted under the exception for 'personal matters about an identifiable individual.' The Ombudsman also found that on both dates, council violated procedural requirements by failing to state the general nature of the matters to be discussed in its resolutions to proceed in camera.
