The appellant, a former employee of the Toronto Board of Education, appealed the Board's decision to deny access to various records relating to his employment, grievances, and Workers' Compensation Board (WCB) matters.
The Board claimed exemptions under sections 7, 8, 9, 10, 12, 13, and 15 of the Municipal Freedom of Information and Protection of Privacy Act.
The Inquiry Officer found that some records were exempt under solicitor-client privilege (section 12), advice or recommendations (section 7), and published information (section 15).
However, the law enforcement, third-party information, and health and safety exemptions were not upheld.
The Inquiry Officer also found that the Board's search for records was unreasonable and ordered a further search, including a search for records under the Board's control but in the custody of its solicitors.
