Partial disclosure ordered for government contract records where only some information met the third-party confidentiality exemption.
The appellant appealed a decision by the Ministry of Economic Development, Trade and Tourism to deny access to records relating to agreements between an Ontario Development Corporation and a named corporation.
The Ministry claimed the records were exempt under sections 17(1)(a) and (c) of the Freedom of Information and Protection of Privacy Act as third party information.
The Inquiry Officer applied the three-part test for the exemption and found that while some information was supplied in confidence and its disclosure could prejudice the corporation's competitive position, the remaining information was not 'supplied' to the Ministry.
The Inquiry Officer upheld the exemption for the supplied information and ordered the disclosure of the rest.
