The applicant requested to defer the hearing of his human rights application against the respondent school board pending the outcome of a grievance arbitration between his union and a different school board.

The Tribunal denied the request, finding that the respondent was not a party to the other proceeding, the subject matters did not clearly overlap, and no remedy could be imposed on the respondent in the other proceeding.

The applicant, who alleged discrimination in employment on the basis of disability (alcoholism), filed a Request for Order During Proceedings seeking the production of 26 categories of documents from the respondent.

The respondent argued that many of the requested documents had already been produced and objected to the timeliness of the request.

The Tribunal applied the 'arguable relevance' threshold and reviewed each request.

The Tribunal ordered the respondent to produce several categories of documents that were arguably relevant and had not been previously produced, including the LHIN's Service Accountability Agreement, On-Call Supervisor Logs, certain performance reviews, and documents relating to lost wages and benefits.

The Tribunal denied other requests where the documents had already been produced, did not exist, or where the request was improper.

The applicant filed an application alleging discrimination in employment on the basis of disability.

The Tribunal issued a Case Assessment Direction requiring the parties to fulfill their pre-hearing disclosure obligations, including providing witness lists and documents.

The respondent complied, but the self-represented applicant failed to provide any of the required materials or confirm his intention to testify.

Consequently, the Tribunal dismissed the application as abandoned and cancelled the scheduled hearing.
