Board finds sale of business occurred and preserves nurses' existing bargaining rights at transferred hospital facilities.
The applicant hospital sought a determination under section 55 of the Labour Relations Act regarding the transfer of two chronic care facilities from Victoria Hospital to Parkwood Hospital.
The Board found that a sale of part of a business had occurred.
The Board further held that the existing bargaining rights of the Ontario Nurses' Association for the full-time and part-time nurses at the transferred facilities should be preserved, as the units remained self-contained and there were no compelling reasons to alter the collective bargaining status quo.
