Panel: 1 - Urban
File: D08-02-25/A-00209
Application: Minor Variance under section 45 of the Planning Act
Applicant: 1000090187 Ontario Inc.
Property Address: 147 Deschamps Avenue
Ward: 12 - Rideau-Vanier
Legal Description: Lot 10 and Part of Lot 11 North of Deschamps Street Registered Plan 113
Zoning: R4UA
Zoning By-law: 2008-250
Heard: October 22, 2025, in person and by videoconference
APPLICANT’S PROPOSAL AND PURPOSE OF THE APPLICATION
1The Applicant wants to convert the existing eight-unit low rise apartment building and add two additional units for a total of ten units.
REQUESTED VARIANCES
2The Applicant seeks the Committee’s authorization for the following minor variances from the Zoning By-law:
a) To permit a reduced front yard projection for a porch of 0 metres from the front lot line, whereas the By-law permits a front yard projection for a porch of 2 metres but no closer than 1 metre from any lot line;
b) To permit a reduced rear yard setback of 10.33% of the lot depth or 2.79 metres, whereas the By-law requires that the minimum required rear yard setback is 30% of the lot depth, or in this case, need not exceed 8.1 metres;
c) To permit increased number of dwelling units in a R4UA zone to 10 units, whereas the By-law states that the maximum number of dwelling units in a R4UA zone is 8 units;
d) To permit reduced rear yard area of 12.35% of the lot area or 50 square metres, whereas the By-law requires that the minimum required rear yard area is 25% of the lot area, or in this case, 101.25 square metres.
3The property is not the subject of any other current application under the Planning Act.
PUBLIC HEARING
Oral Submissions Summary
4Sylvie Lalancette, agent for the Applicant, provided a slide presentation, a copy of which is on file with the Secretary-Treasurer and available from the Committee Coordinator upon request.
5Responding to the Committee’s questions, Ms. Lalancette confirmed that the property has been vacant since 2021. She also advised that the requested variance for the front yard projection relates to the concrete step and roof which is being replaced, and that the variances for the rear yard are for an existing situation.
6City Planner, Dylan Geldart, confirmed no concerns with the application.
DECISION AND REASONS OF THE COMMITTEE: APPLICATION GRANTED
Application Must Satisfy Statutory Four-Part Test
7The Committee has the power to authorize a minor variance from the provisions of the Zoning By-law if, in its opinion, the application meets all four requirements under subsection 45(1) of the Planning Act. It requires consideration of whether the variance is minor, is desirable for the appropriate development or use of the land, building or structure, and whether the general intent and purpose of the Official Plan and the Zoning By-law are maintained.
Evidence
8Evidence considered by the Committee included all oral submissions made at the hearing, as highlighted above, and the following written submissions held on file with the Secretary-Treasurer and available from the Committee Coordinator upon request:
Application and supporting documents, including cover letter, revised plans, photo of the posted sign, and a sign posting declaration.
City Planning Report received October 16, 2025, with no concerns.
Rideau Valley Conservation Authority email dated October 20, 2025, with no objections.
Hydro Ottawa email dated October 10, 2025, with comments.
B. Duhamel, resident, email received October 8, 2025, opposed.
C. Woolsey, resident, email received October 10, 2025, opposed.
Effect of Submissions on Decision
9The Committee considered all written and oral submissions relating to the application in making its decision and granted the application.
10Based on the evidence, the Committee is satisfied that the requested variances meet all four requirements under subsection 45(1) of the Planning Act.
11The Committee notes that the City’s Planning Report raises “no concerns” regarding the application.
12The Committee also notes that no compelling evidence was presented that the variances would result in any unacceptable adverse impact on neighbouring properties.
13Considering the circumstances, the Committee finds that, because the proposal fits well in the area, the requested variances are, from a planning and public interest point of view, desirable for the appropriate development or use of the land, building or structure on the property, and relative to the neighbouring lands.
14The Committee also finds that the requested variances maintain the general intent and purpose of the Official Plan because the proposal respects the character of the neighbourhood.
15In addition, the Committee finds that the requested variances maintain the general intent and purpose of the Zoning By-law because the proposal represents orderly development that is compatible with the surrounding area.
16Moreover, the Committee finds that the requested variances are minor because they will not create any unacceptable adverse impact on abutting properties or the neighbourhood in general.
17THE COMMITTEE OF ADJUSTMENT ORDERS that the application is granted and the variances to the Zoning By-law are authorized, subject to the location and size of the proposed construction complying with the site plan filed with the Committee of Adjustment on October 21, 2025, and the elevations filed with the Committee of Adjustment on October 16, 2025, as they relate to the requested variances; and limited to the lifetime of the building.
