INTRODUCTION AND CONTEXT
[1]. Citoronto Investments Limited made application for variance relief with respect to the property municipally known as 131 McCormack Street.
[2]. That relief was granted by the Toronto Committee of Adjustment, on condition.
[3]. City of Toronto filed an appeal of that decision.
[4]. The Toronto Local Appeal Body (the "Tribunal") fixed a hearing date of November 6, 2025 for that appeal.
[5]. The Parties have been in communication with the Tribunal to the effect that they are pursuing settlement discussions and have requested an adjournment of that hearing to a mutually acceptable date.
[6]. Counsel for Citoronto Investments Limited has suggested a rescheduled hearing date of February 19, 2026, which is acceptable to the City. He has also suggested a fresh set of filing dates tied to that rescheduled hearing date.
THE REGULATORY FRAMEWORK
- Rule 17.2, Tribunal Rules of Practice and Procedure
Where a Party has obtained from the TLAB an adjourn-to date and all Parties consent to an adjournment request and all Participants have been notified of the request no motion is necessary and the TLAB may issue a revised Notice of Hearing.
ISSUES AND ANALYSIS
- The request for adjournment advanced by counsel for Citoronto Investments Limited conforms with the provisions of Rule 17.2.
[7]. The Tribunal has February 19, 2026 available for the hearing of this appeal.
CONCLUSION
[8]. The Tribunal will grant the request for adjournment to the requested date.
DECISION AND ORDER
[9]. The Tribunal ORDERS THAT the hearing date for this appeal will be adjourned from November 6, 2025 to February 19, 2026.
[10]. In connection with this Order, Tribunal staff will issue a fresh Notice of Hearing with fresh filing dates.
