1On April 24, 2024, the Committee of Adjustment refused an application by Ahmadiyya Movement in Islam (Ontario) Inc., the owner of 63 Barker Ave., for 13 variances from the City wide Zoning By-law. The planning examiner’s notice advised:
Your property is subject to the City-wide Zoning By-law No. 569-2013, as amended. Based on By-law No. 569-2013, your property is zoned Residential Semi-Detached RS (f10.5, a325, d0.75)
This proposal is to demolish (the) existing one storey Place of Worship and construct a new 3 storey Place of Worship with residence located on the 3rd storey and green roof
2C-Architecture Ltd submitted an appeal on April 10, 2024. The hearing date was converted to a mediation, which lasted some months, over late 2024 and the beginning part of 2025. On May 1, 2025, Mr. Platt, the lawyer for Ahmadiyya Movement in Islam (Ontario) Inc., withdrew its appeal.
3The appeal having been withdrawn, the appeal is dismissed. The Committee of Adjustment decision noted above is final and binding, and the file of the Toronto Local Appeal Body is closed.
4To tie up all loose ends, nothing further is required of any party or participant, and the status hearing ordered for Thursday, May 29, 2025 is cancelled. The mediation is concluded. The TLAB thanks all persons involved and who have achieved the least cost and most efficient resolution of this matter.
