INTRODUCTION AND CONTEXT
1On August 14, 2024, the Toronto and East York Panel of the City of Toronto (City) Committee of Adjustment (COA) refused four (4) variances for the Committee file number set out above.
2The Applicant before the COA sought permission to construct a new one-storey ancillary building (three-car detached garage with storage) with a driveway in the rear yard of the existing two-and-one-half-storey apartment building at 158 Dowling Avenue (subject property).
3An appeal was submitted to the Toronto Local Appeal Body (TLAB) by Michael Mancini (Mancini Law), the Appellant’s Legal Representative, on behalf of Eduardo Cabral, on September 3, 2024, and the TLAB set a Hearing date for January 10, 2025, to hear the appeal (Appeal).
4On January 6, 2025, the Appellant’s Legal Representative notified the TLAB by email that the Appellant was formally requesting the withdrawal of their Appeal.
WITHDRAWAL
5The appeal having been abandoned, the appeal is dismissed. The Committee of Adjustment decision noted above and dated August 14, 2024, is final and binding, and the Toronto Local Appeal Body file is closed.
6The Hearing scheduled for January 10, 2025, is vacated; no attendance or further submissions are required.
