INTRODUCTION AND CONTEXT
1On October 10, 2024, the Etobicoke York Panel of the Committee of Adjustment (COA) refused nine (9) variances for the Committee file number set out above to permit the Applicant to construct a new detached dwelling with an attached garage on the property municipally known as 73 Thompson Avenue (subject property).
2Martin Mazierski (Mazierski Law), the Appellant’s Legal Representative, filed an Appeal of the COA’s decision with the Toronto Local Appeal Body (TLAB) on October 29, 2024, on behalf of Jeffrey Barratt.
3The TLAB has yet to set a Hearing date to hear the Appeal.
4On November 26, 2024, Mr. Mazierski sent an email to the TLAB informing the Tribunal that the Appellant had decided to abandon the Appeal.
WITHDRAWAL
5The Appeal having been abandoned, the Appeal is dismissed. The Committee of Adjustment decision noted above and dated October 10, 2024, is final and binding, and the file of the Toronto Local Appeal Body is closed.
6The Hearing scheduled for [Insert Hearing Date] is vacated and no attendance or further submissions are required.
