INTRODUCTION AND CONTEXT

1I met with the Representatives/Agents of the Parties involved with 75 Thirty Eighth

2Street on the morning of February 7, 2023, to discuss how the Proceeding could be completed in a reasonable period of time

3The purpose of this Interim Decision is not to list the discussions and conclusions reached by the Parties as a result of the videoconference held on February 7, 2023- the discussions themselves, and the outcomes of those discussions will be recited in a different Decision. The purpose of this Interim Decision is to draw the attention of the Parties to an important deadline that was unfortunately not mentioned during the Hearing.

4At the aforementioned videoconference completed on February 7, 2023, it was decided that each of the Parties would inform the TLAB about their availability between April 1, 2023, and June 1, 2023, so that the TLAB could identify the optimal set of dates on which the Hearings could be held. I inadvertently omitted to provide a deadline to the Parties to complete the process of indicating their availability to the TLAB, and apologize for the same to the Parties.

5In order to expedite the setting of dates, I find that the Parties may be given time until the end of the day (4:30 PM) on February 20, 2023 (Monday) to provide the necessary information to the TLAB about their availability- I take this opportunity to remind each of the Parties to copy other Parties when sending out this information to the TLAB.

6Should the TLAB not receive information from one or more of the Parties, or all of them, by the specified deadline, a decision regarding the schedule of the Proceeding will be made on the basis of whatever information is available.

DECISION AND ORDER

7The Parties are given time till 4:30 PM on February 20, 2023 to indicate their availability between April 1, 2023 and June 1, 2023, to the TLAB, so that the TLAB can identify hearing dates to complete the Proceeding respecting 75 Thirty Eighth Street.

The Parties are reminded herewith to copy each other when sending out the information about their availability to the TLAB.

8Should the TLAB not be in receipt of information about the availability of any one or more the Parties, or all the Parties, a decision regarding scheduling will be made on the basis of such information that is available to the TLAB.
