REVIEW REQUEST NATURE AND RULE COMPLIANCE TO INITIATE
1Max Torokvei, owner of 160 Teddington Park Ave ( the “Site”), filed a request to review the Decision of TLAB Member Yao respecting the Site, which was released on February 8, 2023. My first task is to make sure the correct process has been followed. TLAB Rules 31.1 and 31.2 permit a party to request that the Chair review a decision of any TLAB Member. The Chair may delegate the responsibility of conducting the Review to any member and the Chair has delegated this file to me.
2Under Rule 31.5 of the TLAB’s Rules, the Review request must be served on the TLAB within 30 days and the Applicants has done so within the requisite time period, and have satisfied satisfied the deadlines. Under Rule 31.20, the Responding Party shall Serve a Notice of Response to Review on all Parties and File same with the TLAB no later than 20 Days from the Date the Notice of Review is issued, unless the TLAB directs otherwise - the Parties listed in the TLAB File are the Teddington Park Residents Association ( the Appellants), and Parties Kogut, Ting and Durnford.
3I understand that as of the time this Decision stating the Review Request’s Compliance with the Rules is being served on the Parties, no communication has been received from the Appellants. I find that it would be fair and just to hear from both sides in order to obtain as comprehensive a picture of what took place during the Proceeding.
4I would like to provide an opportunity to the Parties listed in Paragraph [2] above to respond if they choose to, with a deadline of March 24, 2023 to respond. The Moving Party will be given time till April 6, 2023, to file a Reply to the Response, if there is one.
DIRECTION
5The Review Request for 160 Teddington Park Avenue, submitted by the Applicant to the TLAB on February 23, 2023 is compliant with the TLAB’s Rules.
6The Appellants, the Teddington Park Residents Association, as well as Parties Kogut, Ting and Durnford are given time until March 24, 2023, to file a Response to the Review Request. The Applicants will be given time till April 6, 2023 to file a Reply in response to any Response filed by other Parties
