## AND IN THE MATTER OF THE APPEAL AND REQUEST FOR HEARING OF THOROUGHBRED LICENSEE ANANTRAM (SUNNY) SINGH
On October 13, 2011, the Stewards issued Thoroughbred Official Ruling TB 7341/11 wherein Anantram Singh (“Singh“) was suspended from riding for 3 days and placed from 4th to 7th for the following reasons:
Violation of TB Rules 9.14.01, 9.14.02, 9.14.03, 11.07, 11.09.01, 11.09.03, 11.09.05 11.12 and 11.14, did come in with his mount “Pakula” interfering with “Duck Trail” in the vicinity of the three eighths pole during the running of race 6 on October 12, 2011, at Woodbine Racetrack.
On October 14, 2011, Singh filed a Notice of Appeal, pursuant to Rule 13.17 (b) of the Rules of Thoroughbred Racing.
On November 6, 2011, the Stewards issued Thoroughbred Official Ruling TB 7373/11 wherein Singh was suspended from riding for 3 days for the following reasons:
Violation of TB Rules 9.14.01, 9.14.02, 9.14.03, 11.07, 11.09.03, and 11.09.05 , did come in with his mount “Wildcat Times” interfering with “Action Nine” approaching the far turn during the running of race 4 on November 5, 2011, at Woodbine Racetrack.
On December 19, 2012, a Panel of the Ontario Racing Commission (“ORC”), comprised of Chair Rod Seiling, convened for the purpose of hearing these matters.
Tom Miller appeared on behalf of the Administration of the ORC. Singh appeared and was represented by Robert King Jr.
Singh requested his appeals be dropped. The Panel granted the request and assessed costs of $100 for each matter. Singh shall serve the two 3-day riding suspensions when he is re-licensed as a jockey in the 2013 racing season.

**MR. CHAIRMAN:** Okay, so I will accept the request to withdraw both appeals TB 7373/11 and TB 7301/11 and that under policy directive 3/2010 the appellant is fined the sum of $200.00 for dropping an appeal after such a time as the ORC has expended time and resources preparing for the licensee's hearing and these fines will have to be paid along with the outstanding invoices from the previous hearing before he is eligible for licensing.
**MR. MILLER:** There are a couple of things I just want to confirm. When I fill out the forms it will be $100.00 for each one, is that correct?
**MR. CHAIRMAN:** Yes, a total of $200.00.
**MR. MILLER:** And the three day riding suspension are normally served when the season starts back up. How did we want to look after that?
**MR. CHAIRMAN:** They will kick in once he is eligible to have his jockey's licence.
**MR. MILLER:** I will make sure Mr. Fernandes knows that and that can be looked after at that time.
**MR. KING:** So the earliest time for him would be May of 2013?
**MR. CHAIRMAN:** Correct.
**MR. KING:** Upon licensing and there is three separate?
**MR. CHAIRMAN:** Three separate, three days. So he has got six days in total.
**MR. KING:** And the $649.00 in the fines and the two hundred?
**MR. CHAIRMAN:** So add the two hundred to the 649.
**MR. KING:** To the 649, all right.
**MR. CHAIRMAN:** Has to be paid before he can apply for licensing.
**MR. MILLER:** So I will make sure Mr. Fernandes knows what to do with that when Mr. Singh gets his jockey's licence back.
**MR. KING:** Okay, thank you.
**MR. CHAIRMAN:** That's it. We're adjourned. Thank you.
