IN THE MATTER OF THE RACING COMMISSION ACT S.O. 2000, c.20;
AND IN THE MATTER OF THE APPEAL AND REQUEST FOR HEARING BY
THOROUGHBRED LICENSEE CHRISTOPHER GRIFFITH
On June 17, 2012, the Stewards issued Official Ruling TB 7570 wherein Christopher Griffith (“GRIFFITH”) was given a three-day riding suspension for coming in with his mount “Toyoungtoretire” and causing interference to “Tourist Resort” in the vicinity of the half mile pole in the first race on June 16, 2012 at Woodbine Racetrack. “Toyoungtoretire” finished in fifth position and was placed sixth.
On June 18, 2012, GRIFFITH filed a Notice of Appeal, pursuant to Rule 13.17 (b) of the Rules of Thoroughbred Racing.
On August 28, 2012, a Panel of the Ontario Racing Commission (“ORC”), comprised of Chair Rod Seiling, convened for the purpose of hearing this matter.
Brian Newton appeared on behalf of the Administration for the ORC. GRIFFITH did not attend the hearing as he was represented by Jockey Agent Alan Raymond.
Mr. Raymond indicated that GRIFFITH wished to withdraw his appeal. The request was granted.
GRIFFITH will now serve his three-day riding suspension September 1st through to 3rd, 2012, inclusive and is assessed costs of $250 to be paid upon his return.
Take notice that having been granted permission to ride the Simcoe Stake at Woodbine Racetrack on September 3, 2012, GRIFFITH will serve his suspension September 1st, 2nd and 5th, 2012, pursuant to Rule 9.14.02 of the Rules of Thoroughbred Racing.
A transcript of the Panel’s Oral Reasons for Decision is attached to this Ruling.
Dated at Toronto, Ontario this 11th day of September 2012.

MR. CHAIRMAN: Well, we have a policy in place that once an appeal has been filed and the Administration has commenced the work on it we move forward and collect expenses incurred, including having to bring a witness here today.
MR. RAYMOND: Yes, sir.
MR. CHAIRMAN: So what I'm going to do is I'm going to agree to the dropping of the appeal and under Policy Directive 3/2010 the appellant is fined the sum of $250.00 for dropping his appeal after the ORC has expended time and resources preparing for the licensee's hearing.
MR. RAYMOND: Yes, sir.
MR. CHAIRMAN: Thank you.
MR. RAYMOND: Thank you, sir.
MR. CHAIRMAN: And you and Mr. Newton can work out how that will be paid so it won't interfere with his duties.
