COMMISSION HEARING TORONTO, ONTARIO – OCTOBER 23, 2012
IN THE MATTER OF THE RACING COMMISSION ACT S.O. 2000, c.20;
AND IN THE MATTER IN THE APPEAL AND REQUEST FOR HEARING OF
STANDARDBRED LICENSEE MICHAEL ELLIS
On August 29, 2012, the Judges issued Standardbred Official Ruling SB44896 wherein the horse “Cant Stop Rockin” violated SB Rule 22.09 and was placed on the judges’ list for performance and deemed to be dangerous
On August 24, 2012, trainer Michael Ellis (“Ellis “) filed a Notice of Appeal, pursuant to Rule 24.01(b) of the Rules of Standardbred Racing.
On October 23, 2012, a Panel of the Ontario Racing Commission (“ORC”), comprised of Chair Rod Seiling, convened for the purpose of hearing this matter.
Tom Miller appeared on behalf of the ORC. Ellis participated by phone and was unrepresented.
Ellis requested that the appeal be withdrawn and his request was granted. Ellis was assessed costs of $100.
