COMMISSION HEARING TORONTO, ONTARIO – OCTOBER 26, 2012
IN THE MATTER OF THE RACING COMMISSION ACT S.O. 2000, c.20;
AND IN THE MATTER OF AN APPEAL AND REQUEST FOR HEARING OF COREY JOHNSON
On September 21, 2012, the Judges issued Standardbred Official Ruling SB 44900 wherein a 10-day full suspension and a fine of $1,500 were imposed upon Corey Johnson (“JOHNSON”) licence number Y84312, for violating Rules 9.09(a), 26.02.01, 26.02.02, and 26.02.03(c) of the Rules of Standardbred Racing (“SB Rules”) as a consequence of a class IV positive. SB Rules 6.13.01, 9.13, 18.08.01, and 26.08 were also listed in the Ruling.
On September 24, 2012, JOHNSON filed a Notice of Appeal.
On September 25, 2012, the Deputy Director of the Ontario Racing Commission (“ORC”) issued Ruling Number SB 108/2012 wherein JOHNSON’S penalty was stayed pending the disposition of his appeal.
On October 25, 2012, JOHNSON notified counsel on behalf of the Administration of the ORC that he wished to withdraw his appeal.
On October 26, 2012, a Written Hearing was held by Chair Rod Seiling with the following disposition:
a) The withdrawal of the appeal is allowed;
b) In accordance with Policy Directive No. 3-2010, JOHNSON shall pay costs to the Administration of the ORC in the amount of $150 within fifteen days;
c) Standardbred Official Ruling SB 44900 is confirmed: $1,500 fine and a 10-day full suspension (October 28 to November 6, 2012 inclusive).
