COMMISSION HEARING TORONTO, ONTARIO – JULY 23, 2012
IN THE MATTER OF THE RACING COMMISSION ACT S.O. 2000, c.20;
AND IN THE MATTER IN THE APPEAL AND REQUEST FOR HEARING OF STANDARDBRED LICENSEE JESSE EDWARDS
On June 4, 2012, the Judges issued Standardbred Official Ruling SB 43391 wherein Jesse Edwards (Edwards) was given the penalty of a $750 fine and a 15-day full suspension for treating the horse Lizabel, with medications that were not prescribed by a licensed ORC Veterinarian. The horse Lizabel raced in the 6th race at Kawartha Downs on April 14, 2012 and there was a finding of a positive analysis, a violation of SB Rules 6.20 (b) and 6.46.01 (b).
On June 7, 2012, Edwards filed a Notice of Appeal, pursuant to Rule 24.01(b) of the Rules of Standardbred Racing.
On July 23, 2012, a Panel of the Ontario Racing Commission (ORC), comprised of Commissioner John Macdonald, convened for the purpose of hearing this matter.
Neil McCoag appeared on behalf of the Administration of the ORC. Edwards attended the Hearing and was unrepresented.
Edwards gave verbal reasons why he wished to withdraw his appeal. The Panel accepted his reasons and decided not to assess costs. The penalty of a $750 fine and 15-day full suspension stands. The days are July 24 to August 2, 2012 inclusive.

MR. CHAIRMAN: We were here to deal with Mr. Marchment and so we saved some time in that and I don't want to compound the thing and I think that you understand the situation of the Administration and there are costs involved and that's why we brought in the rule that you have to come and explain why you withdrew after the fact and they have gone through the efforts to do this.
MR. EDWARDS: Yes.
MR. CHAIRMAN: And it means that counsel for the Administration had to prepare the material and we had to set it up and staff here has to notify you and everybody else in here but at this stage the industry is in such a concern and upheaval and you've heard that today. You weren't here and we've had difficulties and we know we are still going to have difficulties and so I'm not going to make any changes. I was tempted when I read this but I think we will just leave it as it is, the fine and a 15 day suspension.
