COMMISSION HEARING TORONTO, ONTARIO – NOVEMBER 21, 2012

IN THE MATTER OF THE RACING COMMISSION ACT, S.O. 2000, c. 20;

AND IN THE MATTER OF AN APPEAL AND REQUEST FOR HEARING

STANDARDBRED LICENSEE PHIL HUDON

Phil Hudon (“HUDON”) is licensed by the Ontario Racing Commission (“ORC”) as a Driver/Trainer/Owner (licence number R10216).

On May 23, 2012, the Executive Director of the ORC issued Ruling Number SB 063/2012 to HUDON wherein he was immediately suspended and referred to the Commission.

On October 16, 2012, HUDON submitted an Application for Reinstatement Hearing.

On November 21, 2012, a Panel of the ORC comprised of Commissioner John Macdonald convened for the purposes of considering HUDON’S Application for Reinstatement.

HUDON attended the Hearing and was self-represented. Jennifer Friedman appeared as counsel on behalf of the Administration of the ORC.

Upon reviewing the Agreed Statement of Facts and Joint Submission on Disposition and hearing the submissions of HUDON and counsel, the Panel accepted the Joint Submission on Disposition as follows:

HUDON shall provide all documentation evidencing previous therapy or rehab from September 2010 through September 2012;

HUDON shall forward all future aftercare reports to the Alcohol and Drug Program Administrator forthwith;

HUDON shall enter into a new Post-Violation Agreement for a period of two years;

Any recommendations from his therapy/rehab referenced in paragraph (a) above shall be incorporated into the new Post-Violation Agreement;

All outstanding monies owing to the ORC shall be paid prior to HUDON being reinstated.

Upon satisfaction of the foregoing conditions, HUDON may be reinstated but only by the Alcohol and Drug Program Administrator.
