COMMISSION HEARING TORONTO, ONTARIO – SEPTEMBER 24, 2012

AND IN THE MATTER OF THE APPEAL AND REQUEST FOR HEARING BY STANDARDBRED LICENSEE RONALD ADAMS
On July 25, 2012, the Judges issued Official Ruling SB 45313 wherein Trainer Ronald Adams (“ADAMS”) was given a $500 fine for failing to inform the ORC Director in writing within two days of the death of the horse “Moe Rocks” which occurred on June 30, 2012.
On August 1, 2012, ADAMS filled a Notice of Appeal, pursuant to Rule 24.01 (b) of the Rules of Standardbred Racing.
On September 24, 2012, a Panel of the Ontario Racing Commission (“ORC”), comprised of Chair Rod Seiling, convened for the purpose of hearing this matter.
Brian Newton appeared on behalf of the Administration for the ORC. ADAMS attended the hearing in person and was represented by William O’Donnell, President of the Central Ontario Standardbred Association.
Upon reviewing the evidence, and hearing the testimony of Senior Judge Peter Gillies, ADAMS and reviewing the exhibits filed, ADAMS requested an adjournment to obtain another witness. The Panel granted a continuance of the hearing to be rescheduled for October 23, 2012.

MR. CHAIRMAN: Well, I am prepared to adjourn so that you can get Dr. McCall here at the next B hearings because other then the financial penalty there are no days at stake here right now and the next set of B hearings have been set and we will put this on to accommodate Dr. McCall and if he can't come then the adjournment will not continue and the fine will stay at $500.00. So if Dr. McCall, if you can get him here, that's fine. I am prepared to let you bring him forth as a witness. If he can't come then I'm going to deny your appeal outright and the fine will remain at $500.00. Thank you.
