COMMISSION HEARING TORONTO, ONTARIO – DECEMBER 19, 2012

AND IN THE MATTER OF A REQUEST FOR HEARING OF
THOROUGHBRED LICENSEE ANANTRAM (SUNNY) SINGH
Anantram (Sunny) Singh (“SINGH”) was licensed (license #106524) with the Ontario Racing Commission (“ORC”) as a Jockey.
On December 13, 2010, a Panel of the ORC ordered the following penalty to SINGH (Ruling COM 028/2010):
i) $500 fine;
ii) 12 month suspension, with 10 months stayed [with the stay to automatically expire if SINGH breaches his Post Violation Agreement (“PVA”)];
iii) 40 community service hours with the Long Run Group within the next 12 months;
iv) A new PVA for two years in duration.
On December 14, 2010, SINGH entered into a new PVA with the ORC.
On November 28, 2011, the Deputy Director issued Ruling Number TB ADMIN 63/2011 to SINGH wherein he was immediately suspended for 10 months (November 27, 2011 – September 26, 2012) for breaching his PVA, and required to appear before a Panel of the ORC before licence reinstatement.
On February 7, 2012, the Deputy Director issued Ruling Number TB ADMIN 05/2012 wherein SINGH was rendered ineligible to be licensed until such time as he pays the outstanding amounts owing to the ORC.
On October 22, 2012, SINGH submitted an Application for Reinstatement Hearing.
On November 16, 2012, a Notice of Hearing was issued to advise the parties that a Panel of the ORC would be convening for this matter on December 19, 2012.
On December 19, 2012, a Panel of the ORC, comprised of Chair Rod Seiling, was convened to consider SINGH’S Application for Reinstatement.
Jennifer Friedman appeared as counsel for the Administration of the ORC. SINGH was in attendance. Robert King Jr. acted as his SINGH’S representative.
Upon hearing the testimony of Pamela Bray and SINGH, reviewing the exhibits filed, and considering the submissions, the Panel ordered the following:
a) SINGH must pay all monies owing to the Administration of the ORC, including outstanding invoices in the amount of $649.50;
b) SINGH is fully suspended for three months;
c) At the conclusion of the three month suspension, SINGH is eligible to be licensed for two months as an exercise rider;
d) Prior to reinstatement by the Alcohol and Drug Program Administrator, SINGH shall enter into a new PVA for three years, which PVA shall include the recommendations of a Substance Abuse Professional;
e) If SINGH is licensed for two months as an exercise rider, he may apply for a full jockey’s licence;
f) Should SINGH fail an alcohol or drug test during the course of his PVA, he will be automatically suspended for five years and not eligible for ORC licensing of any kind.

MR. CHAIRMAN: Decision, and I'm taking into it both the mitigating and aggravating factors here and I'm not going to go over them again but certainly I have concern for Mr. Singh's lack of responsibility, his desire to want to rehabilitate himself but I'm also concerned to this point in time he has not been able to and the fact that he has shown very poor judgement and put others at risk, which is totally unacceptable.
So the ruling is Mr. Singh must pay the outstanding invoices that total $649.50. He is fully suspended for three months. At the end of that three months he is eligible to be licensed as an exercise rider for two months. If at that point in time he can apply for a full jockey's licence, it will be up to the Administration to further licence him. Also he must then agree to enter into the new PVA agreement as outlined in the factum. It is a three year agreement and also includes under 1(g) that if he should fail a test he will be automatically suspended for five years and not eligible for licensing of any kind. And Mr. Singh, I don't want to see you here again ever. Well, I won't with this but good luck and please if you do fall off the wagon do not ride. Book off your mounts, have concern for other people and the horses. Thank you.
