COMMISSION HEARING TORONTO, ONTARIO – OCTOBER 23, 2012
IN THE MATTER OF THE RACING COMMISSION ACT S.O. 2000, c.20;
AND IN THE MATTER IN THE APPEAL AND REQUEST FOR HEARING OF
STANDARDBRED LICENSEE RON ADAMS
On July 25, 2012, the Judges issued Standardbred Official Ruling SB45313 wherein Ron Adams (“Adams”) was given the penalty of $500 fine for violation of SB Rule 6.47.01 (a) for failing to inform the Director of the death of the horse “Moe Rocks” on June 30, 2012 at Mohawk.
On July 25, 2012, Adams filed a Notice of Appeal, pursuant to Rule 24.01(b) of the Rules of Standardbred Racing.
On October 23, 2012, a Panel of the Ontario Racing Commission (“ORC”), comprised of Chair Rod Seiling, convened for the purpose of hearing this matter. This hearing was a continuation of an original hearing held on September 24, 2012, before the same panel.
Tom Miller appeared on behalf of the Administration of the ORC. William O’Donnell represented Adams at the hearing.
Mr. O’Donnell offered no new evidence for Adams and the appeal was disallowed. The penalty of $500 fine is confirmed.

MR. CHAIRMAN: Mr. O'Donnell, do you want to report on that situation?
MR. O'DONNELL: Good morning. Mr. Adams called me the other day or last Thursday Friday to say that he couldn't obtain any documentation from Dr.McCaul and therefore he asked me if I would come in and ask if he could withdraw his appeal.
MR. CHAIRMAN: Well, he doesn't have to withdraw it because I already indicated that unless he could provide that documentation that I would have to deny the appeal because he had no evidence to support his appeal.
MR. O'DONNELL: Okay.
MR. CHAIRMAN: So I am just going to make a ruling that the appeal is denied and the fine as assessed by the Mohawk Judges of $500.00 will stand.
MR. O'DONNELL: Okay. Thank you very much.
MR. CHAIRMAN: Okay.
