COMMISSION HEARING TORONTO, ONTARIO – MAY 5, 2011
IN THE MATTER OF THE RACING COMMISSION ACT S.O. 2000, c.20;
AND IN THE MATTER OF THE APPEAL AND REQUEST FOR HEARING BY
STANDARDBRED LICENSEE RENE ALLARD
On March 15, 2011, standardbred, trainer Rene Allard, (“ALLARD”) (ORC Licence #Y8319), appealed Judges’ Ruling SB43192, dated March 5, 2011, wherein he was fined $300 for being late for lasix administration with the horse Sos Master Plan for race 7 at Flamboro Downs on March 5, 2011, in violation of Rule 35.07.07 of the Rules of Standardbred Racing.
On May 5, 2011, a Panel of the Ontario Racing Commission (“ORC”) consisting of Chair Rod Seiling, convened to hear the appeal.
Rick Rier appeared as agent for the Administration. ALLARD attended the hearing in person and was unrepresented.
Upon hearing the testimony of Judge John Dorion, upon reviewing the exhibits filed and upon hearing the submissions of Rier and Allard, the Panel dismissed the appeal.

3 what Mr. Allard has just admitted, it's obvious
4 the appeal is dismissed, both appeals are
5 dismissed. Fines will stand as is.
6 Mr. Allard, because you have admitted,
7 I'm going to not do anything about you being
8 late.
9 MR. ALLARD: Sorry about this.
10 COMMISSIONER SEILING: Well, I travel quite a
11 distance. Mr. Rier has travelled quite a distance
12 to be here in time. In the future you need to allow
13 yourself more time, so I'm not going to do anything
14 about you being 40 minutes late today.
15 THE DEPONENT: Sorry about this.
16 COMMISSIONER SEILING: Your apology is
17 accepted. And given that you have admitted that,
18 I'm dismissing both appeals. Thank you. Court
19 dismissed. Adjourned.
