COMMISSION HEARING TORONTO, ONTARIO – NOVEMBER 23, 2011
IN THE MATTER OF THE RACING COMMISSION ACT, S.O. 2000, c.20;
AND IN THE MATTER OF THE APPEAL AND REQUEST FOR HEARING BY STANDARDBRED LICENSEE J. BRADLEY HARRIS
On October 12, 2011, the Judges issued Official Ruling SB 43613 wherein J Bradley Harris (“HARRIS”) was given a three-day driving suspension for coming in while driving “Bring Home Hinda” and impeding the progress of “Lady Ventures” causing her to go off stride after the 3/4 pole of the second race at Windsor Raceway on October 12, 2011. “Bring Home Hinda” finished in second position and was placed seventh.
On October 13, 2011, HARRIS filed a Notice of Appeal, pursuant to Rule 24.01 (b) of the Rules of Standardbred Racing.
On November 23, 2011, a Panel of the Ontario Racing Commission (“ORC”), comprised of Commissioner Brenda Walker, convened for the purpose of hearing this matter.
Brian Newton appeared on behalf of the Administration for the ORC. HARRIS attended the hearing in person and was self represented.
Upon reviewing the evidence, and hearing the testimony of Senior Judge Paul Harrison and Drivers Terry Tomlin and HARRIS, reviewing the exhibits filed and considering the closing submissions, the Panel denied the appeal. HARRIS will now serve his three-day driving suspension November 28 through to 30, 2011, inclusive.

MS. WALKER: Please be seated. This is an appeal of SB 149/11 Rule 22.05.01(b), impede the progress of another horse or cause it to make a break. On October the 12th, 2011 at Windsor Raceway while driving the horse BRING HOME HINDA in the 2nd race driver Bradley Harris was suspended for three days for causing a horse to go off stride. After reviewing the tapes and hearing the evidence the appeal has been denied. The tape clearly shows that Mr. Tomlin driving number 5 LADY VENTURES did stay in his own path and that Mr. Harris driving number 8 BRING HOME HINDA did drop down and make contact with LADY VENTURES' front legs causing her to make a break. The penalty of three days remains. The days are to be worked out with ... Mr. Newton, do you do that?
