COMMISSION HEARING TORONTO, ONTARIO – NOVEMBER 9, 2011

AND IN THE MATTER OF THE APPEAL AND REQUEST FOR HEARING BY
QUARTERHORSE LICENSEE JESSE DAIGREPONT
On September 27, 2011, the Stewards issued Official Ruling QH 7293/11 wherein Jesse Daigrepont (“DAIGREPONT”) was given a $100 fine for failing to fulfill his riding engagements and failing to notify the race office or Stewards in a timely matter of his unwillingness to ride the horse “Patience Tester” in the eleventh race at Ajax Downs on September 20, 2011.
On September 27, 2011, DAIGREPONT filed a Notice of Appeal, pursuant to the Rule 13.17 (b) of the Rules of Thoroughbred Racing.
On November 9, 2011, a Panel of the Ontario Racing Commission (“ORC”), comprised of Commissioner John Macdonald, convened for the purpose of hearing this matter.
Brian Newton appeared on behalf of the Administration for the ORC. DAIGREPONT did not attend the hearing and was represented by Bob Broadstock.
Mr. Broadstock requested the appeal be withdrawn.
DAIGREPONT will therefore owe a $100 fine payable prior to commencing on the first day of racing for the 2012 season.

MR. MCCOAG: Mr. Daigrepont appealed it immediately upon receiving his suspension and that appeal was immediately faxed in to head office. The next race day he come in and wished to drop his appeal, pay the penalty and drop his appeal. We advised him that he would have to contact head office to drop it. It was head office that would not let him drop it. He did admit at that time that it was a bit of an over reaction on his part. He was a little hasty at making that decision and he did regret it. I think we tried to expediate it and pull it off the roster but it wasn't able to be done.
