COMMISSION HEARING TORONTO, ONTARIO – FEBRUARY 23, 2011
IN THE MATTER OF THE RACING COMMISSION ACT S.O. 2000, c.20;
AND IN THE MATTER IN THE APPEAL AND REQUEST FOR HEARING OF
STANDARDBRED LICENSEE LUC OUELLETTE
On December 13, 2010, the Judges issued Standardbred Official Ruling SB42274 wherein Luc Ouellette (“OUELLETTE”) was given the penalty of a $300 fine and a 5-day driving suspension, December 18, 19, 20, 21, and 22, 2010, for violation of SB Rule 22.23.03(a) and 22.23.04(c) for failure to keep his hands below his head while urging the horse MCARTLEE in race 8 at Woodbine Racetrack on December 11, 2010.
On December 16, 2010, OUELLETTE filed a Notice of Appeal, pursuant to Rule 24.01(b) of the Rules of Standardbred Racing.
On February 23, 2011, a Panel of the Ontario Racing Commission (ORC), comprised of Commissioner Brenda Walker convened for the purpose of hearing this matter.
Rick Rier appeared on behalf of the Administration of the ORC. OUELLETTE appeared at the Hearing and requested to drop his appeal. He had made this request to the Administration some time ago, however, under the new Rules of Procedure he was required to attend to state his intentions.
The Panel accepted OUELLETTE’S request to drop this appeal and advised him to contact the Judges at Woodbine Entertainment Group to establish his days to be served.
